Barrister Jessica Sobey comments in The Law Society Gazette on the impact of social media and online commentary on contempt law.

Jessica’s comments were published in the Law Society Gazette, 20 March 2026.

“In the digital age, the risk of jurors encountering prejudicial material outside the courtroom has increased dramatically. Social media moves quickly, and information, (accurate or otherwise) is readily accessible, making inadvertent exposure far more likely.

“In response, we are seeing a more proactive approach taken in court, with Judges are giving more tailored directions and any contempt of court facing increasingly serious consequences.

“The challenge the courts face is in preserving open justice while protecting the integrity of the trial process. As commentary online and on social media continues to evolve, so too must the safeguards designed to ensure juries remain impartial.”
